Rule and Procedure Table of Contents
a. A&I Facilities and POS Foster Homes
Upon receiving an e-mail message from COoL, the A&I licensing supervisor/manager shall do the following:
· call up each assigned SCR number and complete a CFS 596, Licensing Complaint Report; and
· assign each report to a licensing representative.
The A&I licensing supervisor/manager may direct the licensing representative to conduct additional activities or begin a concurrent licensing complaint investigation during the initial child protection investigation, when appropriate.
The A&I licensing supervisor/manager Review, and approve as appropriate, concurrent and "stand alone" licensing complaint investigations conducted by the A&I licensing representative.
b. POS Day Care Homes
1. New Report of Suspected Child Abuse/Neglect
Upon receiving an e-mail message from COoL, the A&I licensing supervisor/manager shall call up each assigned SCR number and complete a CFS 596, Licensing Complaint Report; and
The A&I licensing supervisor/manager shall do, or shall assign the A&I licensing representative that supervised the POS agency to do the following:
· immediately contact the child protection supervisor or CPSW, by Outlook e-mail, to:
· identify the POS day care licensing supervisor who will assure that a concurrent licensing complaint investigation is conducted, if one is needed;
· consult about the need for and contents of a Protective Plan;
· request that the CPSW provide immediate notice when the decision is made to "unfound" the initial child protection investigation or begin a formal child protection investigation; and
· maintain regular contact with the CPSW throughout the initial child protection investigation.
2. Protective Plan
The A&I licensing supervisor/manager shall (or shall assign the A&I licensing representative to):
· review and revise, if necessary, any Protective Plan developed and implemented by the CPSW; and
· send the CPSW, within 3 days, a copy of any revisions to the Protective Plan that was developed/implemented by the CPSW.
· when the CPSW has not already developed/implemented a Protective Plan, shall develop a Protective Plan, if needed. Shall provide a copy of the Protective Plan to the CPSW within 3 days; and
3. Notice to POS Agency of SACWIS Intake Report / Protective Plan
Within 3 days of assignment, the A&I licensing supervisor/manager shall (or shall assign the A&I licensing representative to) send the CFS 596-F, SACWIS Intake Report / Protective Plan - Licensed POS Day Care Home to the POS day care licensing unit supervisor. The A&I licensing supervisor/manager shall indicate whether a Protective Plan was developed, and, if so, shall attach the Protective Plan and instruct the POS day care licensing unit to monitor the Plan.
4. Notice to POS Agency of Results of "Initial" Child Protection Investigation
The A&I licensing supervisor/manager shall (or shall assign the A&I licensing representative to) send the CFS 596-I, "Initial" Child Protection Investigation Decision - Licensed POS Day Care Home to the POS day care licensing supervisor within 3 days of receiving notice of the decision from the CPSW.
A. Concurrent Licensing Complaint Investigation Not Required
Within 3 days of receiving notification of the final decision to "unfound" the initial child protection investigation, the A&I licensing supervisor/manager shall notify the POS licensing unit, on the CFS 596-I, "Initial" Child Protection Investigation Decision - Licensed POS Day Care Home, of the decision, and shall instruct the POS licensing unit to conduct either a monitoring visit or a "stand-alone" licensing complaint investigation.
i. Monitoring Visit (No "Stand Alone" Licensing Investigation)
The A&I licensing supervisor/manager shall instruct the POS licensing unit to do the following if a "stand alone" investigation will not be conducted:
· conduct a monitoring visit within 30 days (Category I and Category II with Priors allegation) or 60 days (Category II/No Priors allegations);
· document the monitoring visit on the CFS 597-C, Licensing Monitoring Record;
· send a copy of the completed CFS 597-C to the A&I licensing representative within 3 days of the monitoring visit; and
· maintain the completed CFS 597-C in the licensing record.
The A&I licensing supervisor/manager shall specify the licensing standards that, at a minimum, must be reviewed during the required monitoring visit.
ii. "Stand Alone" Licensing Complaint Investigation
[Note: The POS licensing supervisor decides whether to conduct a "stand alone" licensing complaint investigation instead of a monitoring visit. ]
The A&I licensing supervisor/manager shall direct the POS licensing unit to do the following if a "stand alone" investigation is conducted:
· complete a stand alone licensing complaint investigation within 30 days;
· submit the completed investigation documents to the POS licensing supervisor for review and approval;
· develop and implement a Corrective Plan and monitoring schedule, when required and appropriate;
· send a copy of all completed licensing complaint investigation documents, the Corrective Plan and monitoring schedule to the A&I licensing representative within 5 days of obtaining supervisory approval;
· maintain the completed licensing complaint investigation documents, Corrective Plan and monitoring schedule in the licensing record; and
· prepare and submit an enforcement packet, when appropriate.
C. Concurrent Licensing Complaint Investigation Required
Within 3 days of receiving notification from the CPSW that there will be a formal child protection investigation, the A&I licensing supervisor/manager shall:
· notify the POS licensing supervisor, on the CFS 596-I, "Initial" Child Protection Investigation Decision - Licensed POS Day Care Home, that there will be a formal child protection investigation;
· direct the POS licensing unit to conduct the concurrent child protection investigation within 30 days (the POS licensing supervisor may grant one or more 30 day extensions, as needed, pending completion of the child protection investigation);
· specify the licensing standards that, at a minimum, must be reviewed during the concurrent licensing complaint investigation;
· instruct the POS licensing unit to:
o document the concurrent licensing complaint investigation; and
o document substantiated violations.
Within 3 days of receiving notification from the CPSW of a final finding in the Child Protection Investigation, the A&I licensing supervisor/manager shall
· send the CFS # 4a, Notice of Child Protection Investigation Results - Licensed POS Day Care Home to the POS Licensing Supervisor and
· instruct the POS licensing unit to:
: o complete the concurrent licensing complaint investigation;
o submit the completed investigation documents to the POS licensing supervisor for review and approval;
o develop and implement a Corrective Plan and monitoring schedule, when required and appropriate;
o send a copy of all completed licensing complaint investigation documents, Corrective Plan and monitoring schedule to the A&I licensing representative within 5 days of obtaining supervisory approval;
o maintain the completed licensing complaint investigation documents, Corrective Plan and monitoring schedule in the licensing record; and
o prepare and submit an enforcement packet, when appropriate.
